Commonwealth Lawyers’ Association urges Sri Lanka to withdraw proposed judicial retirement age amendment

 

Colombo, July 5 (Daily Mirror) – President of the Commonwealth Lawyers’ Association (CLA), Steven Thiru, has urged the Sri Lankan Government to withdraw its proposed constitutional amendment seeking to extend the retirement age of judges of the Supreme Court and the Court of Appeal, warning that the move could seriously undermine judicial independence and public confidence in the justice system.

Addressing a public forum organized by the Bar Association of Sri Lanka (BASL) on Saturday (04), Steven Thiru said the CLA stood in solidarity with the Sri Lankan legal profession in safeguarding the rule of law and the independence of the judiciary. He commended the BASL for taking a principled stand on the issue, describing the Association as a longstanding defender of judicial independence.

Steven Thiru clarified that the CLA does not oppose increasing the retirement age of judges in principle, noting that several jurisdictions have raised judicial retirement ages in response to increasing life expectancy and the need to retain experienced judges. However, he stressed that such reforms must be implemented through transparent, prospective, and broadly consultative constitutional processes rather than being introduced in a manner that could benefit sitting judges.

Citing reforms in the United Kingdom and Hong Kong, Thiru said successful changes to judicial retirement ages had been preceded by extensive public consultation and were designed as institutional reforms rather than measures benefiting particular individuals. He contrasted those examples with Zimbabwe, where a constitutional amendment extending judges’ retirement ages during the incumbent Chief Justice’s tenure triggered legal challenges and damaged public confidence in the judiciary.

He argued that the principal concern in Sri Lanka was not the proposed retirement age itself but the timing and context of the amendment. According to CLA President, altering the tenure of sitting judges during a politically sensitive period risks creating the perception that the Executive is attempting to influence the composition of the superior courts. Such perceptions, he warned, would erode public trust, which he described as the judiciary’s greatest source of legitimacy.

He further cautioned that extending the tenure of serving judges could adversely affect the morale and career progression of junior judges while reducing constitutional safeguards to instruments of political convenience. He emphasized that constitutional amendments affecting the judiciary should only follow extensive public debate, stakeholder consultation and adherence to democratic due process.

Referring to the Commonwealth (Latimer House) Principles and the CLA’s Goa Declaration of 2023, Thiru said international standards require judicial appointments to be protected by fixed tenure and that judges should never appear to serve at the pleasure of the Executive.

The CLA President also highlighted what he described as growing threats to judicial independence across several jurisdictions, including Kiribati, the Maldives, Ghana, the United States and the International Criminal Court, warning that executive interference with judicial tenure has become an increasingly global concern.

Calling on the Sri Lankan Government to preserve public confidence in the judiciary, Thiru urged it to withdraw the proposed amendment to Article 107 of the Constitution, undertake any future judicial reforms only after transparent consultation with stakeholders, and refrain from unilateral legislative measures that could undermine the independence, impartiality and neutrality of the superior courts.

Capital Gains Tax on vehicles and properties

The Inland Revenue Department has confirmed that individuals selling their residential property or personal vehicles can now do so without paying tax under new rules. For property, sellers are exempt if they have held ownership for at least three years and lived at the location for over two years, with transfers to family members also tax‑free.

On vehicles, the amended act removes the previous tax system, making all personal vehicle sales from April 1, 2024 fully exempt, regardless of age, condition, or model.

High Court upholds prison sentence for Galagodaaththe Gnanasara Thera

The Colombo High Court today upheld the nine‑month prison sentence imposed on Bodu Bala Sena Secretary Venerable Galagodaaththe Gnanasara Thera, rejecting his appeal for acquittal.

The ruling, delivered by High Court Judge Manjula Thilakaratne, confirms the Magistrate’s Court verdict that found him guilty of making a statement insulting Islam at a 2016 Kirulapone media briefing, deemed harmful to communal harmony.

Sri Lanka’s Supreme Court has granted leave to proceed with a high-profile appeal seeking a ruling that Public Security Minister Ananda Wijepala is not qualified to hold a seat in Parliament.

The decision was made after considering an appeal petition filed by former Sri Lanka Podujana Peramuna administrative secretary Renuka Perera.

A three-judge bench comprising Justices Janak de Silva, Menaka Wijesundara, and Sampath Wijeratne reviewed the submissions and unanimously determined that the matter warrants a full hearing.

However, the Supreme Court rejected a request by the petitioner’s side to issue an interim order preventing Minister Wijepala from sitting in Parliament and exercising his voting rights until a final determination is made.

The legal dispute originates from an earlier writ petition filed before the Court of Appeal by Renuka Perera, challenging Wijepala’s position as a Member of Parliament on the basis that he had also been serving as Chief of Staff to the President.

The petitioner argued that holding a state position while serving as an MP constitutes a disqualification under constitutional provisions governing parliamentary eligibility.

During proceedings before the Court of Appeal, the Attorney General raised preliminary objections, pointing out that the President had not been named as a respondent in the petition.

It was also argued that despite holding the role of Chief of Staff, Wijepala did not receive any salary from the government in that capacity, making it legally untenable to classify him as a state employee in terms of disqualification criteria.

Accepting these preliminary objections, the Court of Appeal last year dismissed the writ petition without proceeding to a full hearing.

Subsequently, Renuka Perera challenged that decision before the Supreme Court through the present appeal.

SC allows hearing of appeal challenging Ananda Wijepala’s MP eligibility

Sri Lanka’s Supreme Court has granted permission to proceed with an appeal challenging Public Security Minister Ananda Wijepala’s eligibility to sit in Parliament, after a petition by former SLPP General Secretary Renuka Perera argued that Wijepala’s concurrent role as Presidential Chief of Staff violates constitutional provisions.

The case will now proceed to a full hearing to determine whether Wijepala can legally retain his parliamentary seat while holding executive office.

Two fined Rs 80,000 for feeding wild elephants in Maduru Oya

The Dehiattakandiya Magistrate’s Court has imposed fines of Rs. 40,000 each on two individuals found guilty of feeding wild elephants inside the Maduru Oya National Park, according to the Department of Wildlife Conservation.

The case was filed by wildlife officers attached to the Henanigala Park Entrance Office after an investigation into an incident in April in which several individuals were seen providing various food items to wild elephants, including two elephant calves, for entertainment purposes.

Based on the findings of the investigation, wildlife officers filed legal action against five individuals before the Dehiattakandiya Magistrate’s Court on April 24, 2026.

The court on Thursday (18) convicted two of the accused and imposed fines totalling Rs. 80,000. (Newswire)

Petition filed by former President Gotabaya Rajapaksa

The petition filed by former President Gotabaya Rajapaksa seeking an order preventing his arrest over investigations into the Easter Sunday terrorist attacks was taken up before the Court of Appeal today (17).
The matter was heard before a Court of Appeal bench comprising President of the Court of Appeal Justice Rohantha Abeysuriya and Justice Priyantha Fernando.

During proceedings, Justice Priyantha Fernando stated that he would not be participating in the case due to personal reasons.

The Attorney General informed court that no instructions have yet been received from the respondents in relation to the petition.

President’s Counsel Romesh de Silva, appearing for Gotabaya Rajapaksa, requested the court to issue an interim order preventing his client’s arrest.

However, Deputy Solicitor General Suharshi Herath, appearing for the respondents, informed court that she had received the relevant documents only this morning and had not yet obtained instructions from the respondents.

She further stated that she was unable to give an undertaking that the petitioner would not be arrested without instructions from the respondents.

The Court of Appeal subsequently adjourned the matter until noon for further consideration. (NewsWire)

Former President Gotabaya Rajapaksa has filed a writ petition

Former President Gotabaya Rajapaksa has filed a writ petition in the Court of Appeal seeking an order preventing his arrest or detention in connection with investigations into the 2019 Easter Sunday attacks.

Key points raised in the petition include:

  1. Rajapaksa says he learned through media reports that the Fort Magistrate’s Court had imposed a travel ban on him in relation to investigations stemming from allegations made by Asad Moulana in the Channel 4 documentary on the Easter attacks.

  2. He denies any involvement in the Easter Sunday attacks and states that he has never been questioned by investigators regarding the allegations. He says he is willing to cooperate and make himself available for questioning at any time.

  3. The petition claims there is no need to arrest or detain him as he has undertaken not to leave the country without informing the court and has also undertaken not to interfere with any witnesses.

  4. Rajapaksa alleges that the current investigation is based primarily on claims made by Asad Moulana in the Channel 4 programme and notes that Moulana is currently living overseas. He says he has never met Moulana and has no connection with him.

  5. A major argument in the petition centres on CID Director Shani Abeysekara. Rajapaksa claims Abeysekara may harbour animosity towards him due to past events, including his removal from the CID after Rajapaksa became President and subsequent developments during Rajapaksa’s administration.

  6. The petition argues that several commissions, inquiries and reports on the Easter attacks had highlighted alleged lapses and failures by senior law enforcement officials, including findings relating to investigations conducted by the CID.

7.Rajapaksa further contends that findings of the Presidential Commission of Inquiry, the Parliamentary Select Committee, the Supreme Court judgment on the Easter attacks and the Channel 4 inquiry did not identify evidence linking him to the attacks. He says the only allegation against him stems from Moulana’s claims.

  1. The petition also refers to the findings of the Committee of Inquiry into the Channel 4 documentary, which stated that the allegations made by Asad Moulana were not proven before that inquiry.

9.Rajapaksa says the FBI had conducted extensive investigations into the Easter attacks and that efforts made during his presidency to seek further FBI involvement were met with a response indicating a full investigation had already been carried out.

  1. He argues that there is a likelihood of bias in the ongoing investigation and claims that any attempt to arrest or detain him would be illegal, irrational, unreasonable, disproportionate and in violation of natural justice and his fundamental rights.

  2. Through the petition, Rajapaksa is seeking a writ prohibiting the authorities from arresting, detaining or otherwise depriving him of his liberty in connection with the Easter Sunday attack investigations, pending the final determination of the case.

Badulla Bar Association urges President not to increase retirement age of Superior Court Judges

Colombo, June 15 (Daily Mirror) – The Badulla Bar Association has called on President Anura Kumara Dissanayake not to proceed with any proposed constitutional amendment aimed at increasing the retirement age of members of the judiciary, including judges of the Supreme Court and the Court of Appeal.

In a letter addressed to the President, the Badulla Bar Association stated that it had unanimously passed a resolution expressing its opposition to the proposed constitutional amendment.

Meanwhile, the Association has extended its full support to the Bar Association of Sri Lanka (BASL) in its opposition to the proposed constitutional amendment aimed at increasing the retirement age of apex court judges.

The Association maintained that such an amendment, introduced on an urgent basis, could undermine public confidence in the judiciary and the rule of law.

The Badulla Bar Association’s letter was signed by its President, Dhanushka Weligama, and Secretary, Dileesha Jayasekara.
